By accessing or using the services provided by Media Link Technology ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Services Description

Media Link Technology provides Point of Sale (POS) solutions, including hardware, software, installation, training, and ongoing support services for restaurant and retail businesses. Our services are subject to availability and may be modified or discontinued at any time.

User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information when requested
• Maintain the security of your account credentials and POS system access
• Use our services only for lawful purposes and in accordance with these Terms
• Not attempt to interfere with or disrupt our services or servers
• Notify us immediately of any unauthorized use of your account or system
• Comply with all applicable laws and regulations

Payment Terms

Payment terms for our products and services will be outlined in individual service agreements or quotes. You agree to pay all fees associated with the services you purchase. Prices are subject to change with reasonable notice. Failure to pay may result in suspension or termination of services.

Hardware and Software

For POS hardware and software provided by Media Link Technology:

• Hardware warranties are provided as specified in your purchase agreement
• Software licenses are granted on a non-exclusive, non-transferable basis
• You may not modify, reverse engineer, or distribute our proprietary software
• We are not responsible for data loss; regular backups are your responsibility
• Hardware returns are subject to our return policy as specified at time of purchase

Support Services

Technical support is provided according to the terms of your service agreement. 24/7 support is available for eligible customers. Support response times and service levels are outlined in your specific service agreement. On-site support may incur additional charges.

Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, and software, are owned by Media Link Technology or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Limitation of Liability

To the maximum extent permitted by law, Media Link Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services. Our total liability shall not exceed the amount paid by you for the services in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure.

Indemnification

You agree to indemnify, defend, and hold harmless Media Link Technology, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of our services or violation of these Terms.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Nassau County, New York.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
